(dba Printing Services Ltd. & YourBusinessInPrint.com), HEREIN AFTER REFERRED TO AS ROYAL CLOUGH COMPANIES, RESERVES THE RIGHT TO CHANGE, MODIFY AND AMEND THESE TERMS AND CONDITIONS WITHOUT ANY NOTICE.
LIMITATION OF LIABILITY
In no event shall ROYAL CLOUGH COMPANIES its licensors, suppliers, or vendors, their officers, directors, employees, or agents, be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data or profits, whether or not ROYAL CLOUGH COMPANIES has been advised of possibility of the damage, arising out of or in connection with the use or performance of the site or of failure to provide services that you order from ROYAL CLOUGH COMPANIES or its affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service. In no event shall ROYAL CLOUGH COMPANIES be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of the site or its content.
ROYAL CLOUGH COMPANIES reserves the right to share file content information with its trusted and reputable corporate partners. These partners abide by their own terms of service and privacy policy. Any information you provide to a third party and any dealings you have with the third party will be governed by their privacy and policies sections. ROYAL CLOUGH COMPANIES will NEVER provide your credit card, payment details, or mailing information to any third party, including corporate partners. ROYAL CLOUGH COMPANIES DOES NOT sell customers on mailing lists to any third party.
OFFICE HOURS
Our office hours are 8:30 AM- 5:30 PM Monday – Friday PST. Closed on weekends and holidays.
PRODUCTION TIME
All jobs in by 9:30 AM will be shipped within 5-7 business days (rush orders ship sooner), problem jobs or jobs that require proofs are not considered in this delivery time. Orders do not start in our production schedule until all approvals/payments are received by the customer. Standard Turnaround: ALL ORDERS placed after 9:30 AM, start on our production schedule the next morning after the order (excluding weekends & our company holidays). If the turnaround time is not specified at the time of order, your order will be considered as a 5-7 day shipping request and will be charged accordingly, please note that billing charges won’t be reversed.
RETURNS / REFUNDS
We DO NOT accept returns of any personalized products; print, logo wear or embroidery. Since each order is unique to the customer and has no re-sale value, ALL SALES ARE FINAL.
If WE can verify that an error was made in the interpretation of your order, we will re-print the order. No Refunds or Credit. ROYAL CLOUGH COMPANIES reserves the right to review and replace items damaged as a result of a freight carrier. Customers must notify ROYAL CLOUGH COMPANIES within 5 business days of shipping of any defects, or the claim will be denied. In order to receive replacement the customer must return 100% of the product within 10 days (on their own expense) from the time when the ordered product delivery was taken. All charges related to expedite and order (IE. Rush charges or shipping fees) are NOT REFUNDABLE.
CUSTOMER CONTENT
You understand that all information, data, text, photographs, graphics, messages or other materials ("Content") are the sole responsibility of the person from which such content originated. This means that you, and not ROYAL CLOUGH COMPANIES are entirely responsible for all content that you use from ROYAL CLOUGH COMPANIES gallery or send, upload, post or transmit via our services. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content. You agree to not use our services to send, upload, post or otherwise transmit any content that contains (i) child pornography or anything indecent, obscene, lewd, lascivious, filthy or vile; (ii) a threat to kidnap or injure a person, a threat to injure the personal property or reputation of another person, a threat to accuse any person of a crime, a threat to inform another that a person has violated any law of the United States, or a threat of blackmail; (iii) any matter advocating or urging treason, insurrection, or forcible resistance to any law of the United States; (iv) any defamatory remarks directed at any other person or company; or (v) any content that infringes the intellectual property rights or other proprietary rights of ROYAL CLOUGH COMPANIES or any third party does not control posted by customers and does not guarantee the accuracy, integrity or quality of the content. Under no circumstances will ROYAL CLOUGH COMPANIES be liable to you in any way for any content you may be exposed to that you may find offensive, indecent or objectionable. Products and services, are provided for your personal use only. You agree to abide by these terms of service and not to use these products and services or related messages for any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
You acknowledge that ROYAL CLOUGH COMPANIES does not pre-screen content, but that ROYAL CLOUGH COMPANIES and its affiliates shall have the right (but not the obligation) in their sole discretion to remove any content that violates the terms of service or may otherwise be objectionable. You further acknowledge and agree that ROYAL CLOUGH COMPANIES may preserve content and may also disclose content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the terms of service; (c) respond to claims that the content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of ROYAL CLOUGH COMPANIES, its users and the public.
By submitting art, logos or electronic files/media to ROYAL CLOUGH COMPANIES, you understand and agree that ROYAL CLOUGH COMPANIES reserves the right to display any submitted file content on our website (web-pages) and reserves the right to use said content as sample product for marketing purposes.
GOVERNING LAW
ROYAL CLOUGH COMPANIES is based in Brea, California and all transactions take place on ROYAL CLOUGH COMPANIES servers located in Brea, California. Any legal action or proceeding relating to or arising from your access to or use of this site shall be instituted in Brea, California. You agree to submit to the court of jurisdiction for Brea, California (Orange County, California) and agree that venue in these courts is proper in any such legal action or proceeding.
INDEMINITY
You agree that you shall indemnify and defend ROYAL CLOUGH COMPANIES and all parties from whom ROYAL CLOUGH COMPANIES has licensed portions of content, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to (i) your breach of these Terms of Use or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into products.
By submitting any document, electronic file or art to ROYAL CLOUGH COMPANIES, you agree with our terms and
1. Have verified that spelling and content are correct,
2. Are satisfied with the document layout,
3. Understand that the document will print EXACTLY as it appears,
4. You cannot make any changes once the order is placed,
5. You assume all responsibility for typographical errors.
ORDER APPROVAL
Customers are fully responsible for final proof and layout approval prior to the production process. All files submitted by the customer, approved by the customer and/or authorized by the customer are assumed by ROYAL CLOUGH COMPANIES to be accurate and complete. It is the sole responsibility of the customer to reveiw all information for accuracy. ROYAL CLOUGH COMPANIES assumes NO responsibility for files, proofs or samples that are approved for production by the customer.
ROYAL CLOUGH COMPANIES is NOT LIABLE for errors in a final product caused by any of the following reasons: Misspelling, Graphics, Bleeds, Grammar, Damage Fonts, Punctuation, Wrong Cuts, Incorrect or Missing Folds, Die Lines, Crop Marks, Transparency, Overprint, Computerized Bit/Digitized File Interpretations, or Finished Product Size/Trim. We DO NOT make any changes on customer files. Minimum charge for typesetting and design is $65.00.
PERSONALIZED PRODUCTS
Personalized products, including (but not limited to) print, logo wear & embroidery items, are completely unique to each customer and have no resale value. As such, these items are NOT returnable.
Due to the specialized and handcrafted nature of personalized products, variations between each item (and from custom samples/proofs) may exist. These variations are the result of computerized bit/digitized interpretations and are not material, thread or stitching defects. These variations DO NOT justify a return of completed products.
We DO NOT accept returns of personalized products. Please review your order and custom sample/proof carefully. Once production begins, you are responsible for errors/imperfections that could have been corrected prior to production.
ROYAL CLOUGH COMPANIES provides custom samples/proofs for your review and approval. By authorizing production to begin on raw material, you agree with our terms and have verified that spelling and content are correct. Your approval also indicates that you are satisfied with the layout and that you understand items will appear as indicted. Once we receive approval/authorization and the production process begins, you understand that changes cannot be made and you assume the responsibility for errors.
Please review all orders, items, custom samples/proofs carefully before providing authorization for production and upon receipt of all goods.
ARTWORK, GRAPHICS & DESIGNS
All artwork or designs and images must be provided in CMYK format. ROYAL CLOUGH COMPANIES is not responsible for any color shift that occurs in conversions from RGB to CMYK or PMS Pantone colors to CMYK color modes.
All artwork, designs and images must be provided in minimum of 300 DPI and CMYK color mode. ROYAL CLOUGH COMPANIES is not responsible for images printed as fuzzy, distorted or pixilated due to customer provided artwork.
ROYAL CLOUGH COMPANIES does not, check submissions for spelling, grammar, or any other errors. Designs will be printed as they appear during the approval/proof process. It is the sole responsibility of the customer to ensure that all materials submitted are formatted correctly and free from errors.
COLOR PROOFING & MATCHING
ROYAL CLOUGH COMPANIES is not liable for color matching or ink density on screen proofs approved by the customers. Screen proofs will predict design layout, text accuracy, image proportion and placement, but not color or density.
Application of UV Coating may effect or change the appearance of the printed colors. ROYAL CLOUGH COMPANIES is not liable for the final color appearance of a UV product/s.
Color fidelity warranted by ROYAL CLOUGH COMPANIES is consistent with industry standards for "pleasing color." ROYAL CLOUGH COMPANIES offers no guarantee of "match-print" or "match-product" color fidelity. ROYAL CLOUGH COMPANIES cannot prevent slight color drift throughout an order. ROYAL CLOUGH COMPANIES cannot calibrate the customer’s computer monitor and therefore does not guarantee that the color printed will match the preview as it appears on the customer’s monitor.
ORDER CANCELLATION
ROYAL CLOUGH COMPANIES will be happy to help you cancel your order prior to approval/production. Our Customer Service Team will inform you of any cancellation charges depending on the stage of the order. If a job is canceled, any labor hours (proof, graphics design, etc.) or administrative fees (credit cards fees, etc.) will be subtracted from your refund. Minimum is $15 (15%-30% of total transaction) Once the order has been placed successfully, No Refunds are issued for Logo and Graphic design services. ROYAL CLOUGH COMPANIES is not responsible for any duplicated orders that are placed due to customer mistakes.
RE-ORDERS
ROYAL CLOUGH COMPANIES will not keep order information/electronic files in our system for more than 30 days after the order date. All files need to be re-submitted every time an order is placed. We apologize for any inconvenience this may cause. If you have any questions please contact our customer service department.
ORDER SHIPPING AND DELIVERY
ROYAL CLOUGH COMPANIES will always act to make sure that any production difficulties do not delay delivery schedules. In no case shall ROYAL CLOUGH COMPANIES be liable for any consequential or damages resulting from any delay in shipment or delivery.
All ROYAL CLOUGH COMPANIES customers agree not to hold ROYAL CLOUGH COMPANIES liable for delays in shipments caused by weather conditions, shipping company delays, international customs issues or any other circumstances beyond ROYAL CLOUGH COMPANIES direct control. ROYAL CLOUGH shipment and delivery dates are calculated based upon estimates provided by our suppliers. ROYAL CLOUGH COMPANIES ships product from various locations across the United States. Be advised that your merchandise may ship from any of these locations. If your product needs to reach you by a specific date, be sure the appropriate production time and shipping method, other than ground; at the time you place your order.
ROYAL CLOUGH COMPANIES will always act to make sure that delivery schedules are met. However, unexpected equipment failure, malfunction and or technical problems may delay the printing process. In case of delay caused by technical difficulty, rush charges/fees will be refunded or waived where applicable. However, technical difficulty will not be the grounds for order cancellation.
ROYAL CLOUGH COMPANIES can only use its own shipping account and will not use customer provided account numbers for any couriers. Please note that we don't ship to P.O. Boxes.
SHIPPING ERRORS & LOST PACKAGES
Lost or damaged claims can only be filed for shipments over $50.00 in value and can only be done after 30 days from package shipment. ROYAL CLOUGH COMPANIES is not responsible for 3rd party shipping errors, omissions or damaged shipments. Customer assumes all responsibility related to shipping delays by any carrier.
CUSTOMER SUPPLIED INCORRECT ADDRESS
When a package is not delivered due to an error made by the customer in submitting the proper shipping address, ROYAL CLOUGH COMPANIES will reship the package with corrected address and charge an additional shipping fee for the shipment.
We reserve the right to refuse service without disclosing a reason.
